Welcome to the Privacy Policy for https://www.NMCDLA.org. This Privacy Policy describes the NMCDLA’s use and sharing of Personally Identifiable Information (“PII” – your full name, email address, mailing address, telephone number and/or credit card number) that NMCDLA Registered Members voluntarily provide to the NMCDLA when they register. This Privacy Policy applies to all the services offered by NMCDLA.

We built the NMCDLA.org Website to make it easy to contact and share information with attorneys and other professionals. We understand that you may not want everyone in the world to have the information you share on NMCDLA.org For that reason, we give you control over your information. An important public service that the NMCDLA offers is a free referral program. Any visitor who runs a search can see only those profiles of NMCDLA Registered Members who have selected a “Public Profile.” If referrals are not applicable to your work, or you prefer to be visible to the NMCDLA Registered Members only, you have the option to select a “Private Profile.”

This Privacy Policy is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using NMCDLA.org. By using or accessing NMCDLA.org, you are accepting the practices described in this policy.

The NMCDLA may modify the Privacy Policy to reflect industry initiatives or changes in the law, our PII collection and use practices, the features of the NMCDLA.org Services, or technology, and such modifications shall be effective upon posting by the NMCDLA. Our current Privacy Policy applies to all the information we have about you in your account. Your continued use of the NMCDLA.org Services after the NMCDLA posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes.

Information Collected

When you visit NMCDLA.org you provide us with two types of information: (1) PII you knowingly choose to disclose that is collected by us; and (2) Website use information collected by us as you interact with our Site.

Information we may collect:

We use various internet technologies and information to manage, secure, improve, track use, and provide reliable service to users of the NMCDLA website.

A) Device Information. We (and our hosting server) collect information about the computer, mobile device or other device you use to access the NMCDLA website, such as Internet protocol (IP) addresses, geolocation information, unique device identifiers, operating system, browser type, browser language and other transactional information.

B) Cookies, Beacons, Local Storage and Other Similar Technologies. We use “cookies,” Web beacons, tags and scripts, and other similar technologies including local storage objects such as HTML5. These technologies allow us to manage access to and use of the NMCDLA website, provide interaction personalization, and help us understand how people use the NMCDLA website.

C) Analytics, Log Files and Viewing History. The NMCDLA website and hosting server gathers certain information automatically and store it in log files. This information includes IP address, browser type, operating system and other usage information about the use of the NMCDLA Website, including possibly a history of the pages you view.

NMCDL may use third-party analytics software for review and analysis of any collected information.

Registration

In order to become a NMCDLA Registered Member, you must first create an Account and Membership Profile on this Website. To create an Account, you are required to provide the following contact information: first and last name, email address, username and password.

Profile Information

You may provide additional information on your Membership Profile including: your gender, birthday; educational background; social and volunteer organizations; instant messenger handle/type; past professional experience; and current professional organization, title, contact information, and credentials. Providing additional information beyond what is required at registration is optional, but enables you to better identify yourself and utilize the NMCDLA.org System. You have control over what you share.

You post content on the Website at your own risk. Although we allow you to set a Private Profile that limits the access to your information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that user content you post on the Website will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. You understand and acknowledge that, even after removal, copies of user content may remain viewable in cached and archived pages or if other Users have copied or stored in your user content. Any improper collection or misuse of information provided on NMCDLA.org is a violation of the NMCDLA’s Terms of Use and should be reported to our Web Administrator at info@nmcdla.org.

Cookies & Log Files

Like most websites, NMCDLA.org uses cookies and web log files to track Website usage. A cookie is a tiny data file which resides on your computer which allows NMCDLA.org to recognize you as a user when you return to our Website using the same computer and web browser. Unfortunately, if your browser settings do not allow cookies, you will not be able to log-in to your personal membership profile. Like the information you enter at registration or in your profile, cookie and log file data is used to customize your experience on the Website.

One type of cookie, known as a “persistent” cookie, is set once you’ve logged in to your NMCDLA.org Account. The next time you visit the NMCDLA Website, the persistent cookie will allow us to recognize you as an existing user so you will not need to log-in before using the Service. In order to access or change any of your private information (like a credit card number), however, you must log-in securely again with your Password even if your computer contains your persistent cookie. Additionally, if you log out of the NMCDLA Website you will need to re-enter your Password the next time you visit in order to log-in to your account. Another type of cookie, called a “session” cookie, is used to identify a particular visit to the NMCDLA Website. Session cookies expire after a short time or when you close your web browser.

You can program your computer to warn you each time a cookie is being sent, block third party cookies, or block all cookies. However, by blocking all cookies, you may not have access to certain features on NMCDLA.org.

Due to the communication standards on the Internet, when you visit the NMCDLA Website, we automatically receive the URL of the site from which you came and the site to which you are going when you leave NMCDLA.org. We also receive the Internet protocol (IP) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system, and type of web browser you are using, and the name of your ISP. This information is used to analyze overall trends to help us improve the NMCDLA.org Service. The linkage between your IP address and your personally identifiable information is never shared with third-parties without your permission or except when required by law.

Information Use

The NMCDLA will only use the PII you provide under this Privacy Policy in a manner that is consistent with this Privacy Policy. In order to locate other NMCDLA Registered Members, NMCDLA.org allows NMCDLA Registered Members to search for other NMCDLA Registered Members using registration information (i.e. full name or email address). NMCDLA.org also allows NMCDLA Registered Members to browse for certain profile information in order to help connect with other NMCDLA Registered Members. NMCDLA.org may also allow NMCDLA Registered Members to display some registration information if they choose to do so on their Membership Profile. Search engines may index the portion of a member’s profile (including the profile information it contains) that is publicly displayed.

Other information, that does not personally identify you as an individual, is collected by the NMCDLA from the Website (for example patterns of utilization) and is exclusively owned by the NMCDLA. This information can be utilized by the NMCDLA in such manner as the NMCDLA, in its sole discretion, deems appropriate. The NMCDLA will use this information without identifying you as an individual.

NMCDLA Communications

The NMCDLA will communicate with you through email and notices posted on this website. NMCDLA may periodically use your email address to send you such materials related to the NMCDLA and the NMCDLA.org services as applicable.

Information Sharing

Sharing Information With Third Parties

The NMCDLA takes the privacy of our Users very seriously. We will never sell, rent, or otherwise provide your personally identifiable information to any third parties for marketing purposes which do not support the NMCDLA. We will only share your PII with third parties to carry out your instructions and to provide specific services. For instance, we use a credit card processing company to bill users for subscription fees. These third parties do not retain, share, or store any personally identifiable information except to provide these services and are bound by strict confidentiality agreements which limit their use of such information.

The NMCDLA offers a Public Resources feature, which in relevant part allows any visitor that runs a NMCDLA Registered Member search to see your profile. If you prefer to be visible to NMCDLA Registered Members only, you have the option to select a Private Profile.

We may provide aggregated data about the usage of our services to third-parties for such purposes as we deem, in our sole discretion, to be appropriate. The NMCDLA will use this information without identifying you as an individual.

Partnering with Other Organizations to Offer Combined Services

The NMCDLA employees, agents, or contractors must have a business reason to obtain access to your PII. The NMCDLA may share your PII with those who help us manage or provide NMCDLA.org Services information activities (for example, blog and message board administration, order fulfillment, statistical analysis and data processing), or with outside contractors, agents or sponsors who help us with administration. These outside contractors, agents or sponsors may temporarily store some information on their servers, but they may only use your PII to provide the NMCDLA with a specific service and not for any other purpose.

Legal Disclaimer

We may be required to disclose PII pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share Account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetuated through the NMCDLA.org Service, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

Accessing and Changing Your Account Information

You can review the PII you provided us and make any desired changes to the information, or to the settings for your NMCDLA.org Account, at any time by logging in to your account on NMCDLA.org and editing the information on your Membership Profile page. You can also close your Account through NMCDLA.org. If you close your Account, we will remove your name and other PII from our publicly viewable data. We may retain certain data contributed by you if it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained data will continue to be subject to the terms of the Privacy Policy to which you have previously agreed. To request that we close your Account and remove your information from the NMCDLA.org service, please send your request to our Web Administrator at info@nmcdla.org.

Security

The NMCDLA uses commercially reasonable administrative, technical, personnel and physical measures to safeguard PII and credit card information in its possession against loss, theft and unauthorized use, disclosure or modification.
